Christmas at Tbaar Cup Sleeve Art Contest

Introduction.  Tbaar is launching a 2022 Tbaar Cup Sleeve Art Contest that welcomes young artists to embrace their passion for art and bubble tea. The contest, named “Christmas at Tbaar Cup Sleeve Art Contest'' will launch on June 1, 2022.  Participants will submit their decorated Tbaar white cup sleeves with inspired artwork depicting Christmas in NYC. 

 

The “Christmas at Tbaar Cup Sleeve Art Contest” (herein after known as “Contest”) is hosted by Tbaar, Inc. via Tbaar.com.  The Contest submission period begins June 1st 12am EST and concludes on July 8th at 11:59 PM EST time. Enter by registering for the Contest within the aforementioned period. Two (2) winners will be selected at random for the  Prize, and notified via email. The prize ($5,000) is listed on the appropriate page of the Contest.  Two winners will be selected by Tbaar at random for the Prize.  The Contest is offered electronically over the internet in the United States only, except where otherwise prohibited by law. 

 

Prize must be accepted as awarded with no substitutions.  

 

Eligibility.  NO PURCHASE IS REQUIRED NOR WILL PURCHASE INCREASE YOUR CHANCE OF WINNING (Void where prohibited by law).  All individuals who are New York City (Brooklyn, Bronx, Manhattan, Staten Island and Queens) residents and are 14-25 years of age to enter except employees, representatives, jurors and agents of Tbaar.  All spouses and immediate family of Tbaar employees or jurors may not enter nor win. If you are under 18 years, or otherwise legally incapacitated, you must have your parent’s or legal guardian’s consent to enter this Contest (all herein after known as “entrant”)

 

In addition, to be eligible to win and claim the Prize, the entrant selected for the Prize must authorize Tbaar to announce and publish their names and photographs (if provided with a photograph) (without further remuneration) in any publicity. The declaration form will state that the selected entrant has read, understood, and complied with the rules of the Contest, and that he/she accepts the Prize as offered.  Contestant will be asked to provide Name, Age, Phone Number, Location, School or Educational Background, and Email Address to complete entry.

 

How To Enter.  To participate in the Contest, the entrants submit their artwork in “Christmas at Tbaar Cup Sleeve Art Contest” page in https://www.Tbaar.com/artcontest and agree to the terms of the Contest and submit the artwork (hereinafter known as “artwork”) prior to July 8th, 2022 11:59 p.m. EST Time. Proof of submission does not constitute proof of entry. There is a limit of one (1) entry per person and per e-mail address. Multiple entrants may not submit the same artwork. In the event that two or more entrants submit the same artwork, Tbaar will be entitled to take such action as it deems appropriate in its discretion (which may include, among other things, requiring documentation or other verification of ownership of the artwork, accepting the submission from the first entrant only and/or disqualification of all entrants submitting the same artwork).

 

The following is a list of guidelines for each artwork submitted.

 

  1. Compliance with the template which will include the Tbaar logo

  2. Christmas in New York theme

  3. 2 Dimensional in a high-quality scan if not digital

  4. File size: up to 25 MB.

  5. Entries must be submitted in .jpg, .png, .pdf, .ai, or .eps format.

  6. Digital files must be at least 840 pixels wide. 

  7. Please follow the preferred image naming conventions. -- Name of Artist-name of work.jpg

 

Incomplete, illegible, duplicate, corrupted or untimely entries will be void and disqualified.

 

Determination of whether an entrant and the artwork meet these criteria shall be under the supervision of the Tbaar whose decisions shall be final in all matters relating to this contest.

 

Winning.   The Prizes will be awarded to two persons by a panel of judges based on compliance with the theme of the contest which is Christmas in New York with the Artwork created within the Tbaar Template provided. The Prizes will be delivered to the confirmed winner. The winner will be announced in the “Christmas at Tbaar Cup Sleeve Art Contest” page on July 22, 2022. The selected entrants will be contacted by e-mail ONLY at the e-mail address entered on the registration form.  

 

The selected entrant warrants that they have complied with all Contest Rules and release Tbaar from any liability related to the contest and/or prizes and where legal, sign a publicity release, and return same, properly executed, via email, within 14 days of issuance of notification. Failure to return documents as specified, or if prize notification is returned as undeliverable, will result in the entrant being disqualified, and the prize will be awarded to a potential alternate winner.  A selected entrant will be declared a winner only after meeting all the above terms and conditions.  The name of the winner may be obtained by e-mail sent to info@tbaar.com within 60 days after the draw date of the Contest.

 

The decisions of the Contest judges will be final and binding on all entrants.  This Contest is subject to all applicable Federal, State and Municipal laws and is void where prohibited.  It is the winner’s responsibility to report Prize value as income on State and Federal taxes.

 

Tbaar is not responsible for failure for any reason whatsoever of selected entrant to receive notification.  To ensure that notification will not be sent to Junk Folder, please Whitelist the domain Tbaar.com.  Arrangements for the fulfillment of the Prize will be made by Tbaar which reserves the right in their sole discretion to substitute any or all of the Prize with a Prize of comparable value.

 

General.  

Entrants acknowledge and agree that Tbaar has the right to revise dates and procedures mentioned in these Rules.

 

Tbaar is not responsible for any injury or damage to entrant’s or any other person’s computer system, property or anything stored on or related thereto as a result of participation in, or connection with, this Contest.  Entrants release Tbaar from all liability in connection with the Contest and any Prize won.

 

By entering this Contest, the entrant grants Tbaar, worldwide, irrevocable, non-exclusive, royalty free, sub-licensable right and license to use, publish, reproduce, display, perform, adapt, create derivative works, distribute, have distributed, print, in whole or in part, in any form, in all media forms now or hereafter known, to promote the contest, image, the artist or for editorial or promotional use.

 

The winners of this Contest, agree and acknowledge that all intellectual property in the artwork submitted in the Contest is assigned to Tbaar, upon declaration of the result of the Contest. Each winner will be required to execute such releases, licenses and other documentation as required by Tbaar. The Contest winner will also need to submit the original file of the Artwork to Tbaar for future use.  For the avoidance of doubt, by entering the Contest and/or accepting the prize, the entrant consent to the use his/her/their information submitted for the Contest for advertising, promotional, commercial and other purposes, as determined by Tbaar and its designees without further approval or compensation.  

 

By entering this Contest, entrant represent and warrant that the artwork submitted is an original work of authorship and does not violate any third party’s proprietary or intellectual property rights. If the artwork infringes upon the intellectual property right of another, the entrant will be disqualified at the sole discretion of Tbaar. If the content of the artwork is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, entrant shall, at his/her/their sole expense, defend or settle against such claims. Entrant shall indemnify, defend, and hold harmless Tbaar and each of its directors, officers, employees, agents, and representatives from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Tbaar may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

 

If, for any reason beyond the Tbaar’s control, including without limitation, a virus, bug, non-authorized human intervention, or fraud, the Contest is not capable of running as originally planned, Tbaar, at its sole discretion, shall have the right to terminate, cancel, suspend, or modify the Contest and, Tbaar shall have no liability for any such termination, cancellation, or modification. In such case, Tbaar may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Tbaar. Tbaar reserves the right, in its sole discretion, to disqualify any entrant who tampers or attempts to tamper with the entry process or the operation of the Contest or the Tbaar’s websites or violates these Rules.  The entrant understand and agree that Tbaar has the right, in its sole discretion, to take any action or inaction necessary to maintain the integrity of the Contest.  Any attempt by any entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such attempt be made, Tbaar reserves the right to seek damages to the fullest extent permitted by law.

 

Tbaar is not responsible for error, omission, interruption, deletion, delay in operation or transmission or unauthorized access to or alterations of entries, or for technical, equipment, network, electronic, computer, hardware or software malfunction or inaccurate transmission of or failure to receive entry by Tbaar, even if it affects ability to enter or entry into this Contest.  Tbaar is also not responsible for lost, stolen, misdirected, delayed, destroyed or illegible entries.  All submissions become the property of Tbaar and will not be returned.

 

Dispute Resolution/Choice of Law.  Except where prohibited, entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, and exclusively by an action in state or federal court located in the appropriate courts in New York COUNTY, STATE OF New York, and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Contest but in no event attorneys' fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

 

Privacy.  Tbaar does not share entrants list except as provided in these Rules. All information received will be used for the purpose of this Contest and/or for the execution of this Contest or for marketing purposes as outlined above. When entrant submit information at Tbaar Website, their information is protected both online and offline. The privacy of the Personal Information is very important to Tbaar. Tbaar have security measures in place to protect the loss, misuse, and alteration of personal information under its control. Please be advised that, although Tbaar take every reasonable precaution available to protect the data, no data transmission over the Internet can be guaranteed to be 100% secure. Therefore, Tbaar cannot warrant that the information will be absolutely secure. Any transmission of data at or through its Website is at entrant’s own risk. However, access to entrant’s information is strictly limited, and not accessible to the public. All of Tbaar users’ information, not just the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job are granted access to personal information. Tbaar employees are dedicated to ensuring the security and privacy of all user information. Employees not adhering to Tbaar policies are subject to disciplinary action. In compliance with applicable federal and state laws, Tbaar shall notify entrants and any applicable regulatory agencies in the event that Tbaar learn of an information security breach with respect to the Personal Information. Entrants will be notified via e-mail in the event of such a breach. Please be advised that notice may be delayed in order to address the needs of law enforcement, determine the scope of network damage, and to engage in remedial measures. At an entrant’s request, Tbaar will remove from its database Personal Information that entrant have provided to Tbaar. Entrant may do so by sending an e-mail to info@tbaar.com.

Each time the entrant visits Tbaar Website, the web server automatically recognizes the IP address and the web page from which the entrant came. The IP address is used to help identify the entrant and to gather broad demographic information about the entrants. Tbaar also use the IP address to help diagnose problems with its servers, to administer the Website, and to better serve the entrant in using the services and other features contained within the Website.

 

By submitting the art work, you have affirmatively reviewed, accepted, and agreed to all of the Rules set forth above.
